Entry and implementation conditions for Crumpler Serious GmbH promotions

The operator and entity responsible for the running of the competition, lottery or draw (hereinafter referred to as "promotion" for short) is Crumpler Serious GmbH, Venloer Str. 19, 50672 Cologne (hereinafter referred to "Crumpler" for short). Entry to and the running of the promotion will be in accordance with the following terms.

Section 1 Entry

1. Only persons aged 18 years or over are entitled to enter. Younger persons must obtain the permission of their parent or guardian before entering.

2. An entrant enters the promotion by fulfilling the respective task and/or answering all questions, filling in the form and sending it to Crumpler on time via the medium specified.

3. Employees of the Crumpler group and participating partners and their relatives are excluded from entering. Persons who are not entitled to enter the competition are also not entitled to claim in the event that they are awarded a prize.

4. Each entrant may only enter in his or her own name; prizes cannot be transferred to third parties. In order to enter the promotion, it is absolutely necessary that all personal details are accurate; the entrant is responsible for the correctness of the data entered, particularly the e-mail address given.

Section 2  Implementation and running of the promotion

1. The winner will be selected by a draw from all entrants whose entry form was correctly filled in and received on time.

2. The winners will be notified by Crumpler either by e-mail or in writing and their names may be published. The winner expressly agrees to this form of publication.

3. The prizes on offer will be announced separately in each case in the notices and advertising relating to the promotion. No cash payment or other alternative to the prize will be offered. 

4. The promotion begins following announcement or on the announced start date. The entry deadline, in particular the closing date for entries, will be announced by Crumpler either in the special promotion notices or advertising for the promotion.

Section 3  Exclusion from the promotion, premature termination of the promotion

1. Crumpler reserves the right to exclude from entering the promotion persons who have obtained an unfair advantage through manipulation or who have breached the entry conditions. Upon exclusion from the promotion, the entrant loses any claim to the award of a prize; this also applies where an entrant is excluded after the event. 

2. Crumpler reserves the right to cancel or terminate the promotion at any time without notice. Crumpler shall in particular avail of this opportunity if for technical reasons (e.g. viruses in the computer system, manipulation of or errors in the hardware or software), legal reasons or reasons of force majeure the promotion cannot be run or the prizes offered cannot be awarded.

Section 4  Data protection

By entering, each entrant expressly agrees that Crumpler may for the purpose, duration and running of the promotion store, process, use and pass on to partners participating in the running of the promotion the personal details provided. The entrant is free to revoke this consent at any time and thereby withdraw from participation in the promotion. This revocation can be sent to Crumpler in writing or by e-mail to info@crumpler.eu. The statutory provisions on compliance with data protection, supplemented by the terms of Crumpler’s privacy statement, also apply.

Section 5 Copyright and rights of use

1. In individual parts of the promotion the entrant may avail of the opportunity to submit texts, images or other contributions for publication. In respect of contributions submitted in this manner, the entrant warrants that the contributions are unencumbered by the rights of third parties and that the entrant is the holder of all rights of use and exploitation in the contribution, and in particular that no third party copyright, trademark or personal rights are breached.

2. By entering, the entrant grants Crumpler for the duration of the respective statutory proprietary right the simple, irrevocable right, not limited with regard to territory or content, to use the contribution, in particular to make it publicly accessible, to store, archive, distribute, reproduce, edit, send, in physical or electronic form, digitally or analogue, in and from telecommunications and media services, on the internet, in and from databases, in and from telecommunications, mobile phone, broadband and data networks and on and by data storage media, regardless of the transmission or storage technology. The contribution may be used multiple times, particularly in advertising for Crumpler itself. Crumpler is entitled to delete the contribution at any time. There is no entitlement to compensation or any other claim against Crumpler resulting from the publication of submitted entries. Crumpler may assign the right of use to a third party.

3. The use of brands, titles, logos or other commercial proprietary rights of third parties is forbidden. All content on the Crumpler website is the property of Crumpler and protected under copyright law. The use of text and file content is only permitted with the consent of Crumpler.

Section 6 Liability

1. Crumpler is released from all obligations following completion of the draw and notification of the winner, unless under these conditions or the supplementary notices relating to the promotion this occurs at an earlier point.

2. Crumpler is only liable for damage caused by Crumpler or its agents deliberately or as a result of gross negligence or through a breach of primary obligations (so-called material contractual obligations). This does not apply to damage resulting from injury to life, body or health. 

3. Programs are downloaded at your own risk. The entrant is independently responsible for ensuring that no third party rights are breached. Should the application from Crumpler contain links or cross-references to websites of other providers, it is hereby stated that the content of these websites is outside Crumpler's control and Crumpler has no knowledge of it. All liability of Crumpler in this regard is therefore excluded.

Section 7 Miscellaneous

1. The judges' decision is final. These entry conditions and the entire legal relationship between entrants and Crumpler are exclusively subject to the law of the Federal Republic of Germany.

2. Should individual provisions of the entry conditions be or become invalid, same does not affect the validity of the remainder of the entry conditions.
